Strange Women Lying in Ponds: Why Federal "Tort Reform" Is an Unconservative Idea, via Glenn. What I'm most in favor of tort reform for is that so many times the amounts awarded are enormous and arbitrary. Unfortunately, federal tort reform could wind you up with a system where awards are small and equally arbitrary (even if the cap is the same for everybody), which doesn't seem much, if any, better.

SWLiP writes: "the most desirable "tort reform" of all: a system of judicial appointments that would place judges on the bench who are unafraid to dismiss, or grant summary judgment on, meritless cases."
