What I'm most in favor of tort reform for is that so many times the amounts awarded are enormous and arbitrary. Unfortunately, federal tort reform could wind you up with a system where awards are small and equally arbitrary (even if the cap is the same for everybody), which doesn't seem much, if any, better.
SWLiP writes: "the most desirable "tort reform" of all: a system of judicial appointments that would place judges on the bench who are unafraid to dismiss, or grant summary judgment on, meritless cases."
